Nutanix, Inc. and its group companies (collectively, “Nutanix”, “we”, and “our”) aim to make your experience and interaction with us as informative, personalized, and relevant as possible. To achieve this, we use cookies or similar technologies. This Cookie Notice provides information about how and when we use cookies and similar technologies when you use or access our web-based Offerings, and your rights regarding our use of Cookies. Capitalized terms used in this Cookie Notice have the meaning described in our Privacy Statement unless we provide a definition here in the Cookie Notice.

We use cookies and similar technologies, such as pixel tags, widgets, web beacons, scripts, clear GIFs, JavaScript, embedded URLs, electronic protocols, and other tools and tracking technologies (collectively “Cookies”), to collect personal information, or information that becomes personal information if we combine it with other information. In such cases, our Privacy Statement, which includes additional information about the collection and use of personal information by Nutanix will apply. Where required by applicable law, Nutanix will obtain your consent before we place any Cookies on your device that are not strictly necessary for the functioning of our Offering.

What is a Cookie?

A Cookie is a small snippet of code, pixels, or text files that is placed on your computer or mobile device when you visit a website, online application, or other web-based environment. Almost every website uses Cookies as they help websites operate more efficiently, display custom content, personalize the end user experience, and provide for analytics. Cookies set by the website or application owner (in this case, Nutanix) are called "First-party Cookies".  Only the website or application owner can access the First-party Cookies it sets. Cookies set by parties other than the owner are called "Third-party Cookies".  Third-party Cookies enable third-party features or functionality to be provided on or through the website, online applications, or other web-based environments (e.g. interactive content and social sharing).  The parties that set these Third-party Cookies can recognize your device both when it visits the website in question and also when it visits other websites that have partnered with them.

Why do we use Cookies?

We use Cookies for many different purposes. When you access our Offerings for the first time and periodically thereafter, a pop-up banner will allow you to reject or tailor your Cookie preference settings.

These are the different types of Cookies we or our service providers use in our Offerings:

  • Strictly Necessary Cookies: These are First-party Cookies which are necessary for technical or security reasons to make the Offerings operate and function properly and are called “Strictly Necessary Cookies” since they are strictly necessary to provide you with the Offerings and specific services that you request. Strictly necessary cookies cannot be rejected.
  • Performance Cookies: These Cookies help us analyze and understand how our Offerings are used, count the number of visitors, learn how the Offerings may be improved (such as page navigation), and enhance the performance of our Offerings. These Cookies are intended to improve your experience; however, they are not essential to use our Offerings. As such, you may disable these Cookies, but note that certain functionality of our Offerings (such as videos and other media content) may become unavailable, and we will not know when you have visited our Offerings or be able to monitor their performance.
  • Functional Cookies:  These Cookies enable us to provide enhanced functionality and personalization of the Offerings, and allow us to remember your choices or preferences, such as information on online forms or previous orders. They may be set by us or by third-party providers whose services we have added to our Offerings. They are not used to track your browsing activity on other websites. You may disable these, but keep in mind some or all of these Offerings may not function properly. For example, your settings may not be saved, forms may not auto‑populate, certain tools or embedded features may not load, and you may need to re‑enter information or preferences each time you visit.   • Targeting (or Advertising) Cookies: Targeting Cookies are set by our advertising partners, service providers, social networks, and other third-party websites. They can be used by those companies to build a profile of your interests and show you advertisements tailored to your interests, both on Nutanix Offerings and on other sites.   They also perform functions like preventing the same ad from continuously reappearing and ensuring that ads are properly displayed for advertisers. The information collected through this process does not enable us or them to identify your name, contact details or other personally identifying details unless you choose to provide these. If you disable these Cookies, you will still receive general advertisements, but they may be less relevant or interesting to you.

For EEA and UK users of our Offerings:

The legal basis for the use of Strictly Necessary Cookies is based on our legitimate interest in the technical operation and functionality of our Offerings. It is not necessary to obtain consent for these Cookies, as the use of these Cookies is necessary to provide important functions of the Offerings. The use of Performance, Functional and Targeting Cookies is based on the consent previously obtained from you. You can withdraw your consent to the use of these Cookies at any time via the Cookie Preference Center.

How Nutanix uses Cookies

We (including our service providers) use Cookies for a variety of purposes, including to:

  • Analyze navigation and user experience to improve and enhance our Offerings.
  • Provide personalization for the Offerings.
  • Help us obtain information about how visitors use our Offerings, including creating Site usage statistics without personally identifying visitors.
  • Allow us to process and deliver your orders for products, services, and training and provide content, services, and other information to you.
  • Remember your customized settings and preferences.
  • Provide security, site integrity, and session maintenance, including user authentication, session management, protecting your information from unauthorized entities, and preventing the fraudulent use of user credentials.
  • Ensure that our Offerings work and maintain optimal efficiency and performance.
  • Deliver advertising, features, and content from us and third parties, specific to your interests.
  • Utilize sharing or features with third party social media.
  • Maintain your Cookie preferences. 

Types of Cookies on our Sites and Offerings

Other tracking technologies, pixels, or web beacons

Cookies are not the only way to recognize or track visitors to a website, online application or other web-based environment. We use other, similar technologies from time to time, like web beacons (sometimes called “tags”, "tracking pixels" or "clear gifs"). These are tiny graphics files that contain a unique identifier that enable us to recognize when a user has used our web-based Offerings. This enables us, for example, to monitor user traffic patterns on our Offerings, deliver content and communications through cookies, determine whether you have arrived at our Offerings via advertisements displayed on third-party websites, improve site performance, and measure the effectiveness of email marketing campaigns. In many instances, these technologies are reliant on other Cookies to function properly, so declining Cookies will impair their functioning.

These similar technologies require your prior consent. If you do not wish to enable such tracking, you can withdraw your consent via the Cookie Preference Center. In addition, you can choose to not download any images in emails, or alternatively you may unsubscribe from our mailing lists by updating your choices on our Email Preference Center or by following the unsubscribe link at the bottom of a marketing email.

The use of Google Analytics

We use Google Analytics GA4 on our Offerings, a service provided by Google LLC, located at 1600 Amphitheatre Parkway, Mountain View, California 94043, USA ("Google"), to collect limited data directly from user's browsers to enable us to better understand your use of the Offerings to diagnose and improve our Offerings and to fix issues.

Google Analytics makes use of First-party Cookies placed on our Offerings to provide us with information about the users of our Offerings. Nutanix uses a hybrid tracking model that combines client-side and server-side technologies. This allows us to process data through our own secure servers before it is transmitted to Google.

Further information on how Google collects and uses this data can be found here: https://developers.google.com/analytics.  Google may recognize cookies placed through our Offerings when you visit other websites and applications. Personal information generated by these Cookies about your use of our Offerings, will be transmitted to and stored by Google on servers in the United States of America. This information includes online identifiers (such as cookie IDs and hashed user IDs), device and browser information, approximate geolocation (derived from masked IP addresses), and interaction data (e.g., pages visited, events triggered).  Google will use this information to evaluate your use of our Offerings on our behalf, including providing us reports to assist us with measuring the effectiveness of our advertising campaigns and personalizing content for you.

To enhance privacy, Google only uses pseudonymous data, IP addresses are not logged or stored in a way that can identify users, and only non‑identifying analytics data, such as User‑ID values we generate, is shared with Google for statistical reporting purposes.

In case personal information of EEA and UK users is transferred to Google in the U.S., the information is transferred on the basis of the adequacy decision of the European Commission EU-U.S. Data Privacy Framework (EU-U.S. DPF) within the meaning of Art. 45 para. 3 GDPR, to the extent the recipient is certified under the EU–U.S. DPF. Should the EU-U.S. DPF not be applicable, we will conclude the the European Commission’s Standard Contractual Clauses as issued on 4 June 2021 under Article 46(2) GDPR, including the UK Addendum or the UK International Data Transfer Agreement permitted under Article 46(2) of the UK GDPR for the transfer of data originating in the UK with Google.

The Use of Adobe Analytics

We use Adobe Analytics on our Offerings. This service is provided by Adobe Inc., located at 345 Park Avenue, San Jose, California 95110, USA (“Adobe”). Adobe Analytics helps us better understand how you use our Offerings so we can improve performance and user experience, diagnose issues, and enhance functionality.

Adobe Analytics makes use of First-Party Cookies placed on our Offerings, to provide us with aggregated information about visitors’ interactions. Nutanix uses a client-side implementation of Adobe Analytics.

Adobe may recognize cookies set through our Offerings when you interact with other websites or applications that also use Adobe services. Personal information generated by these cookies about your use of our Offerings may be transferred to and stored by Adobe on servers in the United States. This information includes information about how visitors use our website, including page URLs, timestamps, referring sites, device and browser information, and interaction data. Adobe will use this information on our behalf to evaluate usage patterns, generate reports, measure the effectiveness of our marketing activities, and help us personalize and optimize your experience.

To enhance privacy, Nutanix implements safeguards, including IP truncation and removal of full IP in reporting.

If personal information of users located in the EEA or the UK is transferred to Adobe in the United States, such transfers rely on the EU–U.S. Data Privacy Framework (EU–U.S. DPF) adequacy decision pursuant to Article 45(3) GDPR, to the extent the recipient is certified under the EU–U.S. DPF. If the EU–U.S. DPF is not applicable, we will rely on the European Commission’s Standard Contractual Clauses (SCCs) issued on 4 June 2021 under Article 46(2) GDPR, including the UK Addendum or the UK International Data Transfer Agreement for UK-originating data, as appropriate.
