PROMOTION ELIGIBILITY

You must be an IT professional who is regularly engaged in the procurement of infrastructure software for in your organization.
You represent to Nutanix, Inc. (“Nutanix”) that you have the ability to bind your company to the Promotion Terms & Conditions.
Public sector organizations are excluded.
Test Drive is limited to one per person and a maximum of two persons per organization.
All decisions concerning eligibility are made solely by Nutanix and are final.
False representations of eligibility are disqualifying for participation in the Promotion and receipt of the $100 Amazon card.

Download and reasonable use of the Nutanix test-driven software must be verified.
All software use is subject to the Nutanix demonstration license terms and conditions and the Nutanix reasonable use policy located at: https://www.nutanix.com/legal/eula
All Nutanix demo software is provided “as is” and without warranty of any kind.
All Nutanix demo software may not be used in a live production environment.
Nutanix reserves the right to change the terms of or cancel the Promotion at any time.
This Promotion is also subject to the terms and conditions of applicable agreements concerning any partnership you or your organization may have with Nutanix.
This Promotion is one-time only.
This Promotion is available only in the U.S.
Nutanix is not responsible for any incorrect or inaccurate information associated with or utilized in the Promotion.

The Promotion is governed by the laws of the State of California and any dispute concerning the Promotion will be resolved exclusively in the courts of Santa Clara County, California.
By entering in the Promotion: (i) you represent and warrant that by entering into this Promotion that you are not in violation of your employer’s policies, rules or regulations; (ii) you are not in violation of any federal, state or local government laws or regulations; and (iii) you agree to be bound by these Promotion Terms & Conditions.
Nutanix will not be liable for any loss of profits or for special, consequential, incidental, indirect, reliance, punitive or exemplary damages, either in contract or tort, whether or not the possibility of such damages was disclosed to or could have been reasonably foreseen by Nutanix.
Nutanix’s maximum liability for any and all claims by any person or organization related to the Promotion is $100.00.
Any delay or omission by Nutanix in enforcing its rights under or fulfilling any Promotion requirements will not be interpreted as a waiver of such right or requirement. Nutanix will not be liable for performance delays or for nonperformance due to causes beyond our reasonable control.

Each party is responsible for its own respective income taxes.
